Terms of Use

These Terms of Use govern your access to and use of Clapback AI (the "App"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

01Publisher

Clapback AI is published by Marife Gerodias ("Publisher," "we," "us," or "our").

02What the App Does

Clapback AI is a mobile app that helps users generate suggested written responses to online messages. The App may also connect to a Solana-compatible wallet through supported wallet connection tooling on the device.

The App is provided as an assistive content tool only. It does not provide legal advice, financial advice, investment advice, mental health advice, or professional moderation advice.

03Eligibility

You must be legally able to enter into these Terms under the laws of your jurisdiction. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

04Acceptable Use

You agree not to use the App:

• to create, post, transmit, or promote unlawful, defamatory, threatening, harassing, hateful, discriminatory, fraudulent, or deceptive content;
• to facilitate bullying, targeted harassment, doxxing, impersonation, or abuse;
• to infringe another person's intellectual property, privacy, publicity, or other rights;
• to violate platform rules, applicable law, or third-party terms;
• to reverse engineer, abuse, disrupt, or interfere with the App or connected services except as permitted by applicable law.

You are solely responsible for any text you submit to the App and any content you choose to copy, post, share, or act on after using the App.

05User Content and Output

You retain responsibility for the text you input into the App. The App may process that text to generate suggested responses.

AI-generated output may be inaccurate, incomplete, biased, offensive, non-compliant with third-party platform rules, or unsuitable for your intended purpose. You are responsible for reviewing, editing, and deciding whether to use any output.

We may apply local filtering or moderation measures, but we do not guarantee that all output will be safe, accurate, compliant, or appropriate.

06Wallet Features

The App may prompt you to connect a Solana-compatible wallet available on your device.

By using wallet-related features, you acknowledge and agree:

• blockchain transactions are irreversible;
• public blockchain activity may be visible to others;
• wallet providers are third-party services that we do not own or control;
• we are not responsible for wallet failures, transaction failures, slippage, validator issues, gas or network fees, asset loss, or security incidents caused by third parties.

You are solely responsible for verifying wallet actions before approval.

07Third-Party Services

The App may rely on third-party services, including:

• DeepSeek, to process prompts and return AI-generated text;
• Solana-compatible wallet applications and related mobile wallet infrastructure;
• network, device, and operating-system services.

Those services are governed by their own terms and privacy practices. We are not responsible for third-party services.

08No Unlawful or Harmful Use

You may not use the App to generate or facilitate content involving:

• illegal activity;
• threats or incitement of violence;
• child sexual abuse material or exploitation;
• terrorism or extremist content;
• scams, phishing, fraud, or market manipulation;
• hate speech or targeted degradation of protected groups.

We may limit, suspend, or terminate access where we reasonably believe use violates these Terms, applicable law, or app store policy.

09Intellectual Property

The App, including its software, branding, design, and original content excluding user input and third-party materials, is owned by the Publisher or its licensors and protected by applicable intellectual property laws.

You receive a limited, non-exclusive, revocable, non-transferable license to use the App for its intended purpose under these Terms.

10Disclaimers

We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, wallet, network, or service.

11Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, digital assets, or business opportunities arising from or related to your use of the App.

To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the App or these Terms will not exceed USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12Indemnity

You agree to defend, indemnify, and hold harmless the Publisher from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the App;
• your content or outputs you use or distribute;
• your violation of these Terms, applicable law, or third-party rights.

13Termination

We may suspend or terminate access to the App at any time, with or without notice, if reasonably necessary to protect users, comply with law, enforce these Terms, or respond to abuse or security issues.

Sections that by their nature should survive termination will survive, including those relating to liability, disclaimers, intellectual property, indemnity, and governing law.

14Governing Law

These Terms are governed by the laws of the Philippines, without regard to conflict-of-law principles.

15Changes to These Terms

We may update these Terms from time to time. The updated version will become effective when posted with a revised effective date. Your continued use of the App after changes take effect means you accept the updated Terms.
